Terms of Use

1. What this system is

The system delivers MyCC’s competition-compliance training: course modules, a virtual classroom, an assessment, and a certificate for those who complete it. It is provided for learning, and nothing in it is legal advice. Completing a course does not by itself establish that you or your organisation comply with the Competition Act 2010 or any other law.

2. Your account

Accounts are created by MyCC, or by you through the registration form when registration is open. The details you give must be accurate and must be your own: your certificate will carry the name on your account, and a certificate in the wrong name is worth nothing to the person relying on it.

One account belongs to one person. Keep your password, or the Google account you sign in with, to yourself. Tell us promptly if you believe somebody else has used your account.

3. Signing in with Google

Where your account is matched to a Google account, whoever controls that Google account can reach your learning record. If you lose access to that email address, or it belongs to an employer you are leaving, contact us before you lose it so the account can be moved to an address you keep.

4. Acceptable use

You agree not to:

• Share your account, sit an assessment on somebody else’s behalf, or ask anybody to sit one on yours.
• Copy, record, republish or distribute the course materials or the assessment questions.
• Use automated means to access the system, complete modules, or submit assessment answers.
• Work around the order in which modules must be completed, or any other control the system applies to your progress.
• Attempt to reach another person’s record, or any part of the system you have not been granted.
• Interfere with the system’s operation or its security.

5. Assessment and certificates

Each assessment allows a set number of attempts, shown to you before you begin. Where more than one attempt is allowed, your highest score is the one that counts. A certificate is issued when you meet the requirements of the course, and carries a unique code that anybody you show it to can check on our verification page.

MyCC may withdraw a certificate that was obtained in breach of these terms, or that was issued in error. A withdrawn certificate reports as withdrawn when its code is checked.

6. Course materials

The course materials, including videos, the virtual classroom, assessment questions and certificate artwork, belong to MyCC or to its licensors. You may use them for your own learning. You may not reproduce or redistribute them, or use them commercially, without our written permission.

7. Suspension and removal

We may suspend or remove an account that breaches these terms, that appears to have been compromised, or where we are required to. A suspended account cannot sign in. Where the reason allows it, we will tell you why and what you can do about it.

8. Services we do not operate

The virtual classroom and Google sign-in are provided by third parties, under their own terms. We choose them carefully but we do not control them, and we are not responsible for their availability.

9. Availability

We aim to keep the system available, but it may be interrupted for maintenance or for reasons outside our control. It is provided as it stands, without warranty that it will be uninterrupted or error-free. Nothing in these terms excludes any liability that cannot be excluded under Malaysian law.

10. Changes

We may change these terms as the system changes. The date at the top reflects the current version, and continuing to use the system after a change means you accept it.

11. Governing law

These terms are governed by the laws of Malaysia, and the courts of Malaysia have jurisdiction over any dispute arising from them.
